MEDIATION
Mediation provides a process for leveling the playing field in which parties feel that they are involved in the mediation process and can acquire the best resolution of the dispute. The Firm’s approach is to provide an open and honest environment but simultaneously maintaining confidentiality and integrity of the process. The Firm tries to ensure that the parties feel their interest is being advanced without invoking any sense of bias. The Firm also maintains control of the mediation process and detoxify any situation that may hinder the advancement of the process or sense of comfort for the parties. Further, the Firm will try to ensure that the parties walk away feeling they have reached the best resolution for their dispute.

- Mediated several patent matters including matter involving an international and domestic pharmaceutical licensing dispute of $100 million to $500 million.
- Served as mediator for over 100 large complex commercial disputes.
- Mediated dispute involving licensing agreement for an active pharmaceutical ingredient.
- Mediated breach of licensing agreement involving two international pharmaceutical companies involving pharmaceutical byproducts.
- Mediated trade dress dispute involving hospitality industry.
- Mediated dispute involving processes for an over-the-counter drug agreement.
- Mediated dispute involving healthcare agreements.
- Mediated intellectual property disputes involving patent and trademark infringement in the consumer product industry
- Mediated over 75 disputes involving breach of contract and license agreements
- Mediated patent infringement allegations involving medical device inventions.
- Mediated dispute involving clinical trials and supply license agreement.

- Mediated several environmental disputes involving several insurances carriers involving alleged personal injuries and genetic disorders.
- Served as mediator for two merger & acquisitions disputes; one dealing with specialty business equipment and one involving the agriculture/biotechnology industry.
- Mediated trademark dispute involving restaurant license dispute.
- Mediated two complex environmental litigation matters in federal court with five defendants in one and two defendants in the other that each involved oil spills with allegations of property damage and personal injury with approximately $400 million and $10 million in dispute, respectively. Three of the defendants settled separately in an early individual conference.
- Mediated over 20 employment disputes involving allegations of discrimination and retaliation.
- Mediated an employment matter between three different governmental agencies involving allegations of wrongful termination and tortuous interference with a contract. The amount in controversy was $3.5 million.
- Mediated several commercial litigation disputes involving five franchises over breached licensing agreements; leases; sublease and allegations of failure to produce. The amount in dispute was $50 million.
- Advocated several matters on behalf of clients including 12 patent infringement/validity ($25 million to $100 million in dispute); six licensing disputes (breach of contract; failure to perform and tortious interference with $1 million to $50 million in dispute); six patent interferences (with $1 million to $10 million in dispute) and 50 employment discrimination matters (involving race; gender; sex and religion discrimination; failure to promote; wrongful discharge with $250,000 to $2 million in dispute).
